Dicho expediente fue remitido a esta corporación pero mediante Oficio N-2563, suscrito por la Secretaría del Juzgado Tercero Civil Municipal de Barranquilla, se solicitó la devolución del mismo para poder darle trámite a la impugnación del fallo, por lo tanto para garantizar la protección de los derechos fundamentales al debido proceso y al acceso a la administración de justicia se ordena remitir el expediente al Juzgado que lo solicitó.

- Primero. ORDENAR a la Secretaría General de esta Corporación que, por su conducto, sea remitido el expediente de tutela radicado con el número T-2.801.277 al Juzgado
- Tercero. Civil Municipal de Barranquilla, con el fin de que esa autoridad judicial le de tramite a la impugnación.
- Segundo. Las Sentencias de primera y segunda instancia que sobre la demanda se profieran, se enviarán a la Corte Constitucional para su eventual revisión, tal y como lo disponen los artículos 86 de la Carta Política de 1991 y 32 y 33 del Decreto 2591 de 1991.
